Who You’re Dealing With

BeckettSystems is the trade name of 1001575206 Ontario Inc., an Ontario corporation based in St. Catharines, Ontario, Canada, founded by Austin Beckett. We build and run lead, review, and messaging systems for Canadian contractors. In these Terms, “we,” “us,” and “BeckettSystems” all refer to 1001575206 Ontario Inc. “You” means you and the business you represent. You can reach us anytime at austin@beckettsystems.ca or +1 613-777-6146. These Terms cover your use of beckettsystems.ca, any service you sign up for with us, and any related account.

Agreeing To These Terms

By using beckettsystems.ca, booking a demo, or signing up for the service, you’re agreeing to these Terms and to our Privacy Policy. If you don't agree, don't use the service.

Our service is built for Canadian businesses. To use it, you need to be at least 18, running a real business, and authorized to bind that business to this agreement.

What You’re Getting

The service is the marketing system we describe on our services pages and pricing page. That includes things like a functional website, missed-call text-back, the 5-star review funnel, an all-in-one inbox, automated lead follow-up, local SEO and Google Business Profile optimization, a business phone number, and a CRM connection. Specific features can change as we improve the product. We'll keep the substance of what you signed up for intact.

Pricing And Billing

Current pricing is published on our pricing page and that page is the source of truth. Check there for the latest rate. Subscriptions are billed monthly in advance through Stripe, starting on the day you sign up. Applicable taxes (HST in Ontario, GST/PST elsewhere in Canada) are added on top. If we change our pricing, we'll give you reasonable notice before it affects you.

If a payment fails, we'll let you know and try again. If we can't collect after a reasonable window, we may suspend or cancel your service.

Cancelling

Month-to-month, no contract, cancel whenever. To cancel, email austin@beckettsystems.ca or tell us in writing. Your access continues through the end of the billing cycle you've already paid for. We don’t refund the current billing cycle. That said, if something's gone sideways and you feel you've been ripped off, talk to us. We’d rather make it right than have you tell other contractors otherwise.

When you cancel, your domain and your business data are yours. Always have been, always will be. We'll work with you on a reasonable handover. We'll keep some business records (billing, contracts, account history) for as long as we need them for legal and tax reasons.

What’s Yours, What’s Ours

Your domain, your customer list, your reviews, and your content are yours. The website copy, photos, logos, and brand assets you provide stay yours. The leads and customer relationships built through the system are yours.

The platform itself, the templates, the automation configurations, our code, our designs, our documentation, and our brand are ours. You get a non-exclusive, non-transferable license to use them for as long as your subscription is active. When the subscription ends, that license ends, but anything that was yours coming in stays yours going out.

Acceptable Use

The system is built to run honest marketing for honest businesses. Don't use it to:

• Send spam or unsolicited commercial messages to people who haven't consented under CASL, the U.S. CAN-SPAM Act, TCPA, or the equivalent law where your recipient lives.
• Send harassing, deceptive, threatening, or illegal content.
• Impersonate another business or person.
• Try to break, scrape, reverse-engineer, or overload the platform.
• Run anything that violates Canadian law or the law of the jurisdictions you're messaging into.

You’re responsible for getting consent from your customers before we send messages on your behalf. That means express consent (someone signing up, ticking a box, opting in) or implied consent (an existing business relationship within the windows CASL allows). We can show you how to do this, but the consent is yours to obtain and document.

If we get credible reports that your account is being used to spam or break the law, we may suspend or terminate it. Repeat or serious violations end the relationship.

Third-Party Services

The system runs on top of third-party platforms, most notably GoHighLevel, Twilio (for SMS), Stripe (for payments), Google (for Business Profile, Maps, and possibly Analytics), Meta (possibly Pixel), and our hosting provider. Those services have their own terms and uptime. When they have an outage, the system is affected. When they change their pricing or policies, we may have to pass that through. We'll do our best to choose stable, well-run vendors and to keep you informed when something material changes.

What We Don’t Promise

We're proud of the work and we'll show you receipts from other contractors. But we don't guarantee specific Google rankings, a specific number of leads, a specific volume of reviews, or a specific revenue outcome. Marketing has too many variables (your trade, your market, your follow-up, seasonality) for anyone honest to make those promises. Anyone who does is selling you something.

The service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation Of Liability

To the maximum extent permitted by law, BeckettSystems and its directors, officers, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or lost data, even if we've been told they're possible.

Our total liability to you for any claim arising out of or related to the service is capped at the amount you actually paid us in the three months before the event giving rise to the claim. That's a small number on purpose: the price you pay reflects the risk we're taking on. If you need broader coverage, talk to us about a custom arrangement before signing up.

You Cover Us For Your Misuse

You agree to indemnify and hold BeckettSystems harmless from any claims, damages, fines, or costs (including reasonable legal fees) that come from: (a) your breach of these Terms, (b) content you upload or send through the system, (c) messages sent on your behalf without proper consent, or (d) your violation of any law. In short: if you use the platform to do something you shouldn't, you cover the fallout, not us.

Suspension And Termination

You can cancel anytime as described above. We can suspend or terminate your account if you breach these Terms, fail to pay, use the system in a way that risks our other clients or vendors, or in any case where the law requires us to. We'll give you notice when we can.

Changes To These Terms

We may update these Terms from time to time. The effective date at the top of the page will reflect the latest version. If a change is material, we'll do our best to give you a heads-up before it takes effect, by email or a notice in your account. Continuing to use the service after a change means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute arising out of or related to these Terms or the service will be resolved in the courts of Ontario, and you and we both agree to submit to their jurisdiction. We'll always try to work it out by phone or email first. Court is a last resort.

The Boilerplate

These Terms, together with our Privacy Policy, are the entire agreement between you and BeckettSystems about the service, and replace any prior agreement on the same subject. If a court finds part of these Terms unenforceable, the rest stays in effect. If we don't enforce a right right away, that doesn't mean we've given it up. You can't assign or transfer your rights under these Terms without our written consent; we can assign ours to a successor (for example, in a sale or reorganization).
